Statutory Standards & Scope of Liability

We offer a comprehensive

All vehicles are supplied in strict accordance with the Consumer Rights Act 2015. We warrant that the vehicle is of satisfactory quality, road-safe, road-legal, and fit for purpose at the point of delivery.

However, under UK law, “satisfactory quality” is legally defined relative to a vehicle’s age, mileage, and purchase price. As a specialist in budget-friendly, pre-owned vehicles, we advise that goods will exhibit age-parallel wear and tear. Normal wear consistent with usage, cosmetic imperfections, and minor mechanical noise inherent to an older vehicle’s life cycle are not classified as “faults” or “defects” under this agreement. All advertisements and vehicle descriptions are provided for guidance purposes only; customers are highly encouraged to perform a thorough physical inspection and test drive before finalizing their purchase.

Electronic Diagnostic Verification

To ensure mechanical integrity, our workshop performs and archives a professional, comprehensive digital diagnostic report (via Udiag/Autel systems) for every single vehicle immediately prior to handover to verify a fault-free status.

The customer is strongly urged to request a copy of this report at the point of sale. Any mechanical or electronic fault claimed post-sale will be cross-referenced directly against this archived point-of-sale report to determine if the issue was present at delivery or if it arose due to subsequent usage.

Exclusion of Consumables, Maintenance & External Damage

The following items are legally classified as consumable components or standard owner-maintenance responsibilities. Requests for repair, replacement, or financial reimbursement for these items will be declined unless an inherent manufacturing defect is conclusively proven:

  • Consumables: Tyres, brake pads, discs, light bulbs, wiper blades, and standard vehicle battery health.
  • Fluids: Maintenance of engine oil, coolant, screen wash, and AdBlue levels.
  • External/Environmental Damage: Any component failures or structural damage caused by water ingress, localized flooding, or rodent infestation.
  • Negligence & Alterations: Any faults arising from “self-engineering,” unauthorized modifications, tuning, or a failure to maintain correct fluid levels will immediately void your rights to repair.

Short-Term Right to Reject:

Should a significant, inherent mechanical fault be identified within the first 28 days following purchase, the customer may be entitled to a refund under statutory guidelines. To exercise this right, the customer must provide the business with a reasonable opportunity to physically inspect the vehicle at our Blaydon premises. This allows our technicians to verify the nature, origin, and severity of the issue against our archived point-of-sale diagnostic records.

Repair Procedure & Usage Deductions:

If an inherent fault develops after the initial 28 days, the business is legally entitled to one opportunity to repair or replace the component before a rejection can be considered.

  • Usage Deduction: Pursuant to Section 24(10) of the Consumer Rights Act 2015, should a refund be issued following a failed repair attempt after the initial 30 days, Howay Cars will apply a fair, fixed-rate monetary deduction for the mileage and usage enjoyed by the customer since the delivery date.
  • Road Tax: Please note that the dealership does not manage or refund vehicle Road Tax. Customers must contact the DVLA directly to claim any remaining vehicle tax refunds upon a vehicle return.

Commercial Extended Warranty Terms & Limitations

Any 3-month third-party extended warranty provided at the point of sale is a supplementary commercial guarantee covering major mechanical breakdown (specifically the engine and gearbox) up to a designated claim limit. It does not supersede your statutory rights.

  • Administration & Procedure: Howay Cars does not manage or adjudicate third-party warranty claims. All correspondence, diagnostics, and approvals must be handled directly with the warranty provider according to their strict timelines.
  • Documentation Deadlines: Failure to provide the warranty provider with requested diagnostic reports, supporting photos/videos, or formal repair estimates within 14 days of registering a claim will result in the claim being automatically declined.
  • Exclusions & Excesses: Third-party warranties do not cover main dealer/franchise labour rates, consumable parts, or general wear and tear. Any diagnostic or repair costs exceeding the provider’s designated claim limit are the sole responsibility of the customer.

Workshop Protocol & Third-Party Garage Restrictions

We operate a fully equipped, advanced in-house workshop facility. In the event of a suspected mechanical concern, the vehicle must be returned to our premises for direct assessment by our technicians. Howay Cars will not pay, credit, or reimburse any third-party garage costs, diagnostic fees, or invoices unless explicit, prior written authorization has been issued by our management. Unauthorized third-party inspections or reports will not be accepted as conclusive proof of an inherent fault.

Hybrid Components & Historical Service Records

While we thoroughly inspect every vehicle, we can only certify and take operational responsibility for the specific maintenance and repairs performed within our own specialist workshop. We cannot guarantee the absolute accuracy or completeness of historical service records provided by previous owners or third-party logbooks. Furthermore, the long-term health, capacity, and longevity of Hybrid Batteries cannot be guaranteed or warranted; hybrid vehicles are sold based on the battery’s functional presence and operation at the exact time of sale.

Order Cancellations & Customer Satisfaction

We are entirely committed to transparency. If you are not fully satisfied with a vehicle during the viewing or handover process, we strongly encourage you to decline the transaction before completion. In the event of a vehicle return processed within a valid statutory cooling-off period, a fixed administration fee of £150 + VAT will apply to cover logistical, vehicle preparation, and re-listing overheads.

Our workshop rates remain significantly more competitive than mainstream garages and main dealers across the North East. As a thank-you for choosing us, please retain your original vehicle sales invoice. Presenting this invoice for any future out-of-warranty servicing or repairs will entitle you to an exclusive 20% loyalty discount on our standard workshop labour rates.
